Terms and Conditions for College Graduation Photography Session

These terms and conditions govern the provision of college graduation photography services by Alex Harrison Photography, (the "Service Provider") to the client ("Client"). By booking and using our services, the Client agrees to these terms and conditions.

1. Booking and Payment: To book a college graduation photography session with the Service Provider, the Client must pay a non-refundable retainer fee of 50% of the total cost, which will be applied towards the total session fee. The balance of the session fee must be paid in full at least 7 days prior to the scheduled session. If the Client fails to make payment in full by the deadline, the Service Provider reserves the right to cancel the booking.

2. Cancellation and Refund Policy: The Client may cancel the booking by providing written notice to the Service Provider at least 7 days prior to the scheduled session. If the Client cancels within this time frame, the Service Provider will refund any payments made, minus the non-refundable retainer fee. If the Client cancels within 7 days of the scheduled session or fails to show up for the scheduled session, no refund will be given.

3. In the event that the Service Provider has to cancel the session due to unforeseen circumstances, every effort will be made to reschedule the session at a convenient time. If this is not possible, the Service Provider will refund any payments made by the Client.

4. Session Time and Location: The Client must arrive at the scheduled session location on time. Any delay caused by the Client will reduce the amount of time available for the session, and the Service Provider will not be responsible for any resulting loss of photographs or time. If the Client is more than 20 minutes late, the session may be canceled at the discretion of the Service Provider.

5. The Client is responsible for selecting the session location and must obtain any necessary permits or permissions. The Service Provider will not be responsible for any loss of photographs or time resulting from the Client's failure to obtain the necessary permits or permissions.

6. Delivery of Photographs: The Service Provider will provide the Client with access to an online gallery of edited digital photographs within 2 days after the session. 

7. Ownership and Use of Photographs: The Service Provider retains the copyright and all other intellectual property rights in the photographs taken during the session. The Client may use the photographs for personal use only and may not sell or license the photographs to any third party without the prior written consent of the Service Provider.

8. Liability and Indemnity: The Service Provider will take all reasonable care in providing the photography services. However, the Service Provider will not be liable for any loss, damage, or injury arising from the session, except where such loss, damage, or injury is caused by the negligence of the Service Provider.

9. The Client will indemnify and hold the Service Provider harmless from any claims, damages, or expenses arising from the Client's use of the photographs taken during the session.

10. Governing Law: These terms and conditions will be governed by and construed in accordance with the laws of Nevada, Arizona, Utah, California, Illinois, Kentucky, Indiana, Michigan, and Iowa, without giving effect to any principles of conflicts of law.

11. Entire Agreement: These terms and conditions constitute the entire agreement between the Client and the Service Provider with respect to the provision of college graduation photography services. Any changes to these terms and conditions must be made in writing and signed by both parties.
